I Won't Back Down

Dear Friends,

Well I know what's right, I got just one life
In a world that keeps on pushin' me around
But I'll stand my ground and I won't back down
Tom Petty and the Heartbreakers..."I Won't Back Down"

The final battle is upon us and I really never envisioned it would be over the issue of gender identity and bathrooms. The US Justice Department has told North Carolina that its "Bathroom Law" constitutes the highest form of discrimination and is a violation of the civil rights of those with Gender Identity Disorder. The Attorney General stated that North Carolina's law violates the 1964 Civil Rights Act, which prohibits discrimination based on race, sex or religion. So hanging a Men or Women sign on a restroom door is now the same as hanging a sign that says "White Only" or "Black Only". The Governor of North Carolina showed some testicular fortitude and filed a lawsuit against the Justice Department. The crux of the argument is whether or not the Congress in 1964 intended to include the transgendered within the definition of sex. Obviously this will be an issue that heads to the Federal Courts. The answer the courts give will be the difference between living in a democracy or an "idiot-acracy".

In the meantime the US Department of Education has issued a mandate to all Public Schools (K-Graduate Level) that failure to permit a student who self-identifies as the opposite gender use of the restroom of his/her choice will result in loss of Federal dollars for education in that School District. Meanwhile there is no clear definition of transgendered; it seems to be the subjective view of an individual's self-perception. The schools must accept without challenge a student's "internal sense of gender". Teachers and principals are going to have a massive headache dealing with that definition since it basically means any student on any given day at any given moment can self identify as the opposite gender. The Department of Education may not realize it but our high schools tend to have mischievous, horny sixteen-year-old boys who will have a field day in the Girls Room.

In the meantime the Fourth Circuit Court ruled that a Virginia High School discriminated against a transgendered boy by not allowing him to use the Girls restroom and locker room. The school did create a single use restroom for anyone who was uncomfortable with the gender specific restroom but that compromise was dismissed out of hand. The Court ruled that the young man would be "irreparably harmed" if he was not allowed to use the Girls Room. Irreparably harmed is a big statement to make especially when a majority of boys and girls with GID successfully resolve the issue as they mature. But what about the girl who was sexually assaulted or raped, will she not be irreparably harmed by knowing now that when she goes to the restroom a man might be in there? Will she be too afraid to use the restroom or locker room or shower? Don't her feelings count? Apparently not according to the Court. The 99.7% of the population that is not transgendered are graciously now permitted by the court to use the restroom stall to change clothes or shield themselves from a person of the opposite gender who is using the restroom or locker room.

Many have brought up the issue of sexual predators using the new all inclusive restroom policy as a pretext to stalk their prey. They of course are dismissed as fear mongers and bigots. Well one thing I can tell you from years of Safe Environment Training and Screening no matter how strong your gate keeping is sexual predators still try to find a way in. So why wouldn't they take advantage of the all-inclusive restroom? What a great defense for a voyeuristic pervert: "I just felt like a woman so leave me alone". Creepy. (It is important to note that GID is not an issue of sexual orientation. Most transgendered remain heterosexual, as is Caitlyn (Bruce) Jenner who has said he is attracted to women).

The Fourth Circuit Court, the US Justice Department and the US Department of Education all suffer from a grave deficiency in reality contact. But we do not need to suffer the same. Losing this battle would put the final nail in the coffin of the Judeo Christian vision of the human person upon which we have built our society, our laws and public policies, our medical system and our logic.

So now is the time for all of us but especially our men to "step into the breach". Men please stand up and defend our women, your wives, daughters, mothers and sisters. Protect their dignity and purity. Do not back down. Remember logic is on your side, science is on your side, and love is on your side.

Love, Fr. John B.

P.S. Private and Parochial Schools do not fall under this new mandate, yet. But if and when they do you can be assured it will only happen at our School over my dead body.
